5.     Purchase Policy

 

 

All User’s have the option to purchase goods offered by the company on its operating website, under the conditions defined herein.

In addition to the services defined in clause 3 of this Agreement, Infinite Exchange also offers the customer the possibility of adding items to cart, whereby the customer is entitled to select the desired products for him/her and make the purchase at the checkout section of the site. Purchase can only be made by cashless method.

 

 

 

When placing an order, the user is redirected to the payment page where he/she fills out data of the bank card. After submitting this information order to make payment is being processed and confirmed by the bank.

We do not have access neither to the payment page nor to the bank card data specified by the user. If the payment is successful, notification with relevant information will be displayed on the screen.

After completing the payment procedure, the user receives an e-mail with confirmation that the order was placed successfully.

The price of the goods on the website is given in US Dollars. The Infinite Exchange company is authorized to periodically update the value of the goods placed on the website in its own discretion. The change in the value of the goods will not be applied to orders already placed.

6.     Risk of loss

 

All purchases made on Infinite Exchange are subject to shipping, which means that the risk of loss passes to the carrier from the moment the item is handed over to him.

 

7.     Name of Product

 

We strives to be as accurate as possible in describing a product and the name of the item, however we do not warrant that the Products, items or any description are absolutely accurate, reliable, current or flawless. If a product is listed on the site but does not match the description, our sole remedy is to return it original form for default.

 

8.     The Price Of Product

 

"List Price" means the suggested retail price of the Product as provided by the manufacturer, supplier or retailer. We regularly check the listed prices against prices recently found at Infinite Exchange and other retailers. Sold by Infinite Exchange For goods, we cannot confirm the price of the item until you place the order. Despite our best efforts, the price of a small number of items in our catalog may be incorrect.

 

If the correct price of a product posted on Infinite Exchange is higher than the advertised price, we will, at our own initiative, contact you for further instructions or cancel the order and notify you accordingly.

 

We generally do not charge your credit card until your order has been processed or for digital products until we offer you a physical product.

 

9.     Our Responsibilities

 

The company shall not be liable for any damage caused to the Customer and/or third parties on the basis of incorrect information provided by the Customer. In the event of a breach of the rules and conditions governing the use of the website, the Infinite Exchange company reserves the right to suspend the user's account in question.

 

The Infinite Exchange Company hereby disclaims any liability to itself or to any of its employees for any alleged violation of this document or applicable law by a user.

 

The Infinite Exchange company absolves itself of any liability for damages resulting from negligence, as well as in instances where the information required for user authorization has been disclosed to a third party. The Infinite Exchange company is obligated to adhere strictly to these regulations. The Infinite Exchange company holds no responsibility for the security of the card identification data provided by the user. The Infinite Exchange company bears no responsibility in instances where, due to technical issues or temporary failures, customers are unable to purchase desired goods.

The Infinite Exchange Company shall not be held liable in the event that the non-fulfillment or partial fulfillment of its obligations is caused by force majeure events, including but not limited to, fires, explosions, accidents, epidemics, pandemics, floods, and other unforeseeable circumstances beyond its control.

 

The Infinite Exchange company reserves the right to unilaterally modify the rules governing the purchase and/or settlement of goods at its discretion. The Infinite Exchange company is obligated to deliver the goods to the customer in accordance with the terms outlined in the contract. The goods shall be considered in conformity with the terms of the contract if they align with the description provided by the Infinite Exchange company to the customer and possess the same characteristics as the samples of the goods provided on the website to the customer.

11. Costumer rights

 

If the goods turn out to be defective, a costumer shall have the right to request that it replace the defect (repair or replace the goods free of charge, or reduce the price) or withdraw from the contract.

 

The right to repair and replace the goods is a top priority right of a costumer. A costumer shall have the right to request to repair or replace a received damaged goods free of charge within 14 business days of the purchase of the item, except for the case where it is impossible to do so due to the nature of the goods, or where it requires disproportionately or unreasonably high costs and/or did not have a defect when purchasing the goods.

 

To exercise the rights outlined herein, the costumer is required to contact us via email at customerservice@Infinite-exchange.com.

 

The goods purchased by the costumer are eligible for repair or replacement only upon confirmation of the existence of a material defect in the purchased goods by an expert opinion recognized by Us.

 

According to the expert opinion of the Infinite Exchange company, in the event of confirming the existence of a defect at the time of purchase, "Infinite Exchange will facilitate the repair of defective goods, and if repair is not feasible, its replacement.

 

Goods shall be repaired or replaced within a reasonable time in order to not adversely affect a costumer, taking into account the nature and the intended purpose of purchasing such goods.

 

12.    Return Policy

 

The customer is entitled to submit a request for the return of a Received Damaged purchased item within 14 calendar days from the date of delivery. This period commences from the moment the goods are transferred to the customer.

 

After this period elapses, the customer forfeits the right to request a return. To initiate the return process, the customer must submit a return ticket via email to: customerservice@Infinite- exchange.com. For more information please see our Return Policy page

 

13. Termination

 

This Agreement shall become effective once you have registered a User Account on the Service and shall continue until your Account is terminated by you or us as provided for under these terms.

 

We may terminate or suspend your right to access and license to use the Service at any time by providing you with email notice of such termination. If Infinite Exchange terminates User’s access to the Service for violation of this Terms, User will not be entitled to any refund. If Infinite Exchange terminates User’s account for any reason, the User is prohibited from registering and creating a new account under another name, a fake or borrowed name, or the name of any third party, unless Infinite Exchange gives express consent thereto.

 

14.    Intellectual Property

 

The Website contains trademarks, logos, service names and trade names of Infinite Exchange Ltd or third parties which may be registered or otherwise protected by Georgia law. You are not permitted to use any trade marks, logos, service names, trade names or any other Content or copies of the Content appearing on the Website.

We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Services at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance of the Services.

Infinite Exchange represents and warrants that (i) it owns or has the lawful license to utilize all intellectual property rights necessary to provide the Service and Services and to perform its obligations under this Agreement; (ii) the Services will be performed in a timely, professional, and workmanlike manner in accordance with industry standards; and (iii) it shall comply with all applicable laws and shall obtain and maintain, at its own expense, all approvals, permissions, permits, licenses, and other forms of documentation required for Infinite Exchange’s performance under this Agreement.

 

21.  Limitation of Liability

 

We are not liable for the completeness, accuracy or correctness of any information uploaded on our Services and any Related Content. You expressly agree that your use of the Services and our Service, including reliance on any Advice, is at your sole risk. You agree not to use the Services, and the Related Content for any re-sale purposes, and we have no liability to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with these Terms (including but not limited to the use of, or inability to use, the Services, our Services or any other website or software).

 

22. Consumer Data Processing & Privacy

 

Infinite Exchange complies with all applicable data protection and privacy laws and regulations in the performance of its obligations set out under these Terms, including the EU General Data Protection Regulation 2016/679 (“GDPR”), the UK General Data Protection Regulation (“EU GDPR”) the Data Protection Act 2018, in each case including all other successor legislation and regulation thereto.

 

Infinite Exchange processes personal data (as such term is defined in the Data Protection Laws) which it collects as a data controller (as the term is defined in the Data Protection Laws) in the course of providing the Services. Where data is processed by Infinite Exchange as a data

controller, such processing is carried out in accordance with Infinite Exchange Privacy Policy. Infinite Exchange processes such categories of personal data as are described in the above referenced Privacy Policy.

 

23. Governing Law

 

These terms and conditions is governed and interpreted in accordance with the laws of Georgia. Any dispute raised between the parties must be resolved through negotiations, and in case of failure to reach an agreement, the case will be considered by the Tbilisi City Court.
